Competition Terms and Conditions
1. Introduction
Information on how to enter, mechanics of entry and prizes form part of these Conditions of Entry. Entry into the promotion is deemed acceptance of these Conditions of Entry.
2. Eligibility
Entry is only open to persons aged 18 years or older (Entrants). The directors, management and employees (and their immediate families) of Entrada Travel Group (Promoter), its related entities, providers and agencies who are directly associated with the conduct of this promotion are ineligible to enter the promotion.
3. Promotional Period
The promotional period starts at 5.30 pm (NZDT) on the 17th of February and closes at 11.55pm (NZDT) on the 9th of March 2025.
Entry will be available via the Promoter’s Social Media channels (Facebook and Instagram). All valid entries received during the Promotional Period will be included in the draw.
4. How to Enter
Post on your personal Facebook or Instagram profile with a video or photo of your marine-related Seaweek activities and tag the Promoters’ Official Facebook (https://www.facebook.com/aucklandwhaleanddolphinsafari) or Official Instagram (https://www.instagram.com/aucklandwhaleanddolphinsafari/) accounts in your post during the promotional period.
Only one (1) entry per person is permitted for each eligible period of the competition. Any subsequent entry by the same person after the first valid entry is received from that person will be deemed invalid.
Entries received will be considered final by the Promoter. Incomplete, artificial (using AI-generated imagery or video), manufactured, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid. The Promoter accepts no responsibility for late or misdirected entries.
5. Draw
The prize draw will take place at Level 1, Building A, The Millennium Centre, 600 Great South Road, Greenlane, Auckland, at 12pm (NZDT) on Monday 10th February 2025.
All valid entries received during the Promotional Period(s) will be entered into the corresponding Draw to determine one (1) winner.
The winner will be notified by direct message to their social media profile and their name will be announced in a social media post, by the 7th business day after the draw. All reasonable steps to notify winners of the results of the Draws will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.
6. Prizes
For the Draw, the first eligible entry randomly drawn from all entries received during the Promotional Period will win the prize of a Family Pass for 2 Adults and 2 Children for an Auckland Whale and Dolphin Safari.
The winner will be contacted by the Promoter to arrange the delivery of the prize voucher. The validity of the prize redemption is 12 months (365 days) from the date a winner is notified that they have won. Block out dates may apply to the use of the voucher.
The Promoter reserves the right to request a winner produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the identity of the winner before issuing the prize.
7. General
The total prize value is $599 NZD. The prize is not transferable or exchangeable and cannot be taken as cash. The prize can only be redeemed for a standard Auckland Whale and Dolphin Safari tour. The prize cannot be used or redeemed in conjunction with any other offer. The prize does not include any accommodation or any other expenses relating to travel, accommodation or food and drink.
The Promoter may conduct an unclaimed prize draw which will take place at Level 1, Building A, The Millennium Centre, 600 Great South Road, Greenlane, Auckland, as is necessary at the end of 48 hours after the draw in order to distribute the prize if unclaimed by that date. In the event of an unclaimed prize draw, the winner will be notified in writing (direct message). All reasonable steps to notify the winner of the results of the unclaimed prize draw (if any) will be taken by the Promoter. The Promoter’s decision is final and no further correspondence will be entered into.
Entrants can only enter in their own name. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the promotion and all entries of an Entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right to request the Entrant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the Entrant’s identity, eligibility to enter and claim a prize, and any information submitted by the Entrant in entering the promotion, before issuing a prize. If any documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an Entrant or entry has not been verified or validated to the Promoter’s (or its nominated agent’s) satisfaction then all the entries of that Entrant may be ineligible and deemed invalid.
The Promoter reserves the right to verify the validity of any and all entries and to disqualify any Entrant for: (a) tampering with the entry process; (b) submitting written entries or imagery generated using artificial intelligence; (c) submitting an entry which is not in accordance with these Conditions of Entry; or (d) engaging in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
An entry and any copyright subsisting in an entry irrevocably becomes, at time of entry, the property of the Promoter.
To the maximum extent permitted by law, you agree that Auckland Whale and Dolphin Safari will not be liable to you for any loss or damage, however caused, arising out of your participation in the Promotion.
If the promotion is not capable of running as planned for any reason beyond the reasonable control of the Promoter, including because of war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the promotion and/or if necessary to provide alternative prize(s) to the same value as the original prize(s), subject to any written directions made under applicable legislation.
Entrants can gain access to, update or correct any of their Personal Information held by the Promoter by contacting the Promoter at marketing@entradatravelgroup.com. All Personal Information will be stored by the Promoter in accordance with the Promoter’s Privacy Policy. A copy of the Promoter’s Privacy Policy in relation to the treatment of Personal Information collected may be obtained by contacting the Promoter.
You acknowledge that the Promotion is not sponsored, endorsed, administered by, or associated with Meta, Facebook and Instagram and that Meta has no liability to you in relation to the Promotion. You agree to fully release Meta from any and all liability in relation to your participation in this Promotion.
Interpretation: In these Terms and Conditions, unless the contrary intention appears:
the singular includes the plural and vice versa;
dates or times are Auckland, New Zealand dates or times;
a reference to ‘include’ or ‘including’ means ‘including but not limited to’.
If part or all of any clause of these Terms and Conditions is illegal, invalid or unenforceable then it will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible, it will be severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.
